Terms and Conditions

These terms and conditions create a contract between you and iStaging (the “Agreement”). Please read the Agreement carefully.

  1. INTRODUCTION TO OUR SERVICES

    • This Agreement governs your use of iStaging’s services (“Services”), through which you can subscribe to iStaging’s cloud service, apps, and other in-app services (collectively, “Content”). Content may be offered through the Services by iStaging or a third party. Our Services are available for your use in your country of residence (“Home Country”). To use our Services, you need compatible hardware, software (latest version recommended and sometimes required) and Internet access (fees may apply). Our Services’ performance may be affected by these factors.

  2. USING OUR SERVICES

    • PAYMENTS, TAXES, AND REFUNDS

      You can acquire Content on our Services for a charge, which is referred to as a “Transaction.” Each Transaction is an electronic contract between you and iStaging, and/or you and the entity providing the Content on our Services. iStaging will charge your selected payment method (such as your credit card, debit card, or other method available in your Home Country) for any paid Transactions, including any applicable taxes. If we cannot charge your selected payment method for any reason (such as expiration or insufficient funds), you remain responsible for any uncollected amounts, and we will attempt to charge the payment method again as you may update your payment method information. In accordance with local law, iStaging may update information regarding your selected payment method if provided such information by your financial institution. All Transactions are final. Content prices may change at any time. If technical problems prevent or unreasonably delay delivery of Content, your exclusive and sole remedy is either replacement of the Content or refund of the price paid, as determined by iStaging. From time to time, iStaging may refuse a refund request if we find evidence of fraud, refund abuse, or other manipulative behavior that entitles iStaging to a corresponding counterclaim.

    • HARDWARE

      We'll ship your kit to the address provided at the checkout within 10 working days. We are not liable for any custom & import taxes that may be incurred. The 720° Lens and Rotator can only be used with the eligible plans as per our official pricing table. Note that the devices will be of no use if you downgrade or cancel your subscription. We reserve the right to refuse to fulfill any orders we deem fraudulent or abusive. For hardware such as Insta360, please refer to this website: https://www.insta360.com/. iStaging is not liable for any orders placed from other websites not related to our company, or not following our branding guidelines.

      Returns policy of hardware:
      Our exchange policy on hardware lasts for the first 7 days of hardware delivery. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. Once your return is received and inspected, we will send you an email to notify you that we have received your returned item within 24 hours. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card, within 7 days.

    • ISTAGING ACCOUNT

      Using our Services and accessing your Content may require an ISTAGING ACCOUNT. An ISTAGING ACCOUNT is the account you use across iStaging’s services. Your iStaging account is valuable, and you are responsible for maintaining its confidentiality and security. iStaging is not responsible for any losses arising from the unauthorized use of your iStaging account. Please contact iStaging immediately if you suspect that your iStaging account has been compromised.
      Proceeding with the purchase of any of the available plans, you give your consent to iStaging to send you emails such as feature updates, news, collaborations, insights, and promotional emails. You have the right to unsubscribe by yourself or request to be removed from the email list. Then, your email won't be stored in our marketing email list and you would not receive any marketing email. iStaging would not pass your data and your email to any third party collaborations without your consent.

      iStaging has the right to change pricing plans, features specs and prices. Any changes will be mentioned help center, email marketing and/or solutions.

    • SERVICES AND CONTENT PAY BY USAGE RULES

      Your use of the Services and Content must follow the rules set forth in this section (“Pay By Usage Rules”). Any other use of the Services and Content not in compliance with the Pay By Usage Rules is a material breach of this Agreement. iStaging may monitor your use of the Services and Content to ensure that you are following these Pay By Usage Rules.

      • - You may access our Services only using iStaging’s software, and may not modify or use modified versions of such software.
      • - The term “App” includes apps for any iStaging platform and/or operating system, in-app purchases, extensions (such as keyboards), stickers, and subscriptions made available in an app.
      • - You can use Apps on any device that you own or control.

    • SUBSCRIPTIONS

      The Services and certain Apps may allow you access to Content on a subscription basis (“Subscription”). Your subscription shall begin upon your registration with iStaging (“Registration”), and shall automatically renew on a monthly basis until cancelled in the Manage Account section of your account settings. Upon Registration, you will be charged a membership fee (“Membership Fee”), which will be charged every month upon renewal of your subscription. We will notify you if the Membership Fee increases and, if required, seek your consent to continue. Your subscription shall renew before the first day of the next billing period and you will be charged your Membership Fee no more than 24 hours prior to the start of each renewal of your subscription. If we cannot charge your Payment Method for any reason (such as expiration or insufficient funds), and you have not cancelled the subscription in accordance with this Agreement, you remain responsible for any uncollected amounts, and we will continue to attempt to charge the Payment Method (defined below) on file. This may result in a change to the start of your next subscription period and may change the date on which you are billed for each period. We reserve the right to cancel your subscription at any time if we are unable to successfully charge your Payment Method to renew your subscription. Certain subscriptions may offer a free trial prior to charging your Payment Method.

    • PAY BY USAGE - PAYMENT PER PIECE

      The Services and certain Apps may also allow you to purchase access to iStaging's live tour service (each a "LiveTour") on a pay-by-piece basis (each an “Extra LiveTour Charge”). Extra LiveTour Charges will be charged at the end of each subscription period and depends on your actual usage, calculated as follows: your Extra LiveTour Charge for the relevant month will be calculated based on the highest number of LiveTours that you have used in any given day in the month, less the number of LiveTours (if any) that you are included with your subscription. The management of LiveTours and Extra LiveTour Charges can be found in the Manage Account section of your account settings. We will notify you if the price of a LiveTour increases and, if required, seek your consent to continue. You will be charged at the end of the month. If we cannot charge your payment method for any reason (such as expiration or insufficient funds), you remain responsible for any uncollected amounts, and we will attempt to charge the payment method as you may update your payment method information. We reserve the right to cancel your subscription if we are unable to successfully charge your payment method to collect the outstanding Extra LiveTour Charges.

    • BILLING AND Cancellation
      • - Billing Cycle. The Membership Fee for the Services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees or Extra LiveTour Charges, will be charged to your Payment Method on the specific billing date(s) indicated on your "Billing Information" page. The length of your billing cycle will depend on the type of subscription that you choose when you first time create the VR content. In some cases your payment date may change, for example if your Payment Method has not successfully settled or if your subscription began on a day not contained in a given month. Visit our website and click on the "Billing details" link on the "Managing Account" page to see your next payment date. We may authorize your Payment Method in anticipation of Membership Fees or service-related charges through various methods, including authorizing it for up to approximately one month of service upon your Registration.
      • - Payment Methods. To use the Services you must provide one or more payment methods (each, a “Payment Method”). You authorize us to charge any Payment Method associated to your account in case your primary Payment Method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration of your Payment Method(s), insufficient funds, or otherwise, we may suspend your access to the service until we have successfully charged a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees relating to the processing of your Payment Method. Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details.
      • - Updating your Payment Method(s). You can update your Payment Method(s) by going to the "Account" page. We may also update your Payment Method(s) using information provided by the payment service providers. You hereby authorize us to continue to charge the applicable Payment Method(s) following any such updates by you or by your payment service providers.
      • - Cancellation. You can cancel your iStaging subscription at any time, and you will continue to have access to the relevant Services through the end of your billing period. To the extent permitted by the applicable law, payments are non-refundable and we do not provide refunds or credits for any partial subscription periods or unused iStaging content. To cancel, go to the "Managing Account" page and follow the instructions for cancellation. If you cancel your subscription, your account will automatically close at the end of your current billing period. To see when your account will close, click "Billing details" on the "Account" page. If you signed up for iStaging using your account with a third party as a Payment Method and wish to cancel your iStaging subscription, you may need to do so through such third party, for example by visiting your account with the applicable third party and turning off auto-renew, or unsubscribing from the iStaging service through that third party. You may also find billing information about your iStaging subscription by visiting your account with the applicable third party.
      • - Changes to the Price and Subscription Plans. We may change our subscription plans and the price of the Services and/or the Membership Fee from time to time; however, any price changes or changes to your subscription plans will apply to subsequent billing cycles following notice of the change(s) to you.
      • - Promotions & Special Prices: Any promotions and special prices are only valid for the time advertised. After the special subscription price expired, the renewed price will be according to the official website's pricing or portal's price. Tthe above term will not be followed, if mentioned otherwise during the promotion or deal.
      • - Coupon: All the coupon including the promotion coupon are only valid for 3 months from the purchasing date. If the coupon is not redeemed after 3 months, the coupon will no longer available.
  3. YOUR SUBMISSIONS TO OUR SERVICES

    • Our Services may allow you to submit materials such as panoramas, pictures and videos. Your use of such features must comply with the Submissions Guidelines below, which may be updated from time to time. If you see materials that do not comply with the Submissions Guidelines, please use the Report a Concern feature. You hereby grant iStaging a worldwide, royalty-free, perpetual, nonexclusive license to use the materials you submit, including but not limited to for iStaging's use within the Services and related marketing, and for iStaging's internal purposes. iStaging may monitor and decide to remove or edit any submitted material at its sole discretion.

    • Submissions Guidelines: You may not use the Services to:
      • - post any materials that you do not have permission, right or license to use;
      • - post objectionable, offensive, unlawful, deceptive or harmful content;
      • - post personal, private or confidential information belonging to others;
      • - request personal information from a minor;
      • - impersonate or misrepresent your affiliation with another person, or entity;
      • - post or transmit spam, including but not limited to unsolicited or unauthorized advertising, promotional materials, or informational announcements;
      • - plan or engage in any illegal, fraudulent, or manipulative activity.

  4. MISCELLANEOUS TERMS APPLICABLE TO ALL SERVICES

    • CONTRACT CHANGES

      iStaging reserves the right at any time to modify this Agreement and to add new or additional terms or conditions on your use of the Services. Such modifications and additional terms and conditions will be effective immediately and incorporated into this Agreement. Your continued use of the Services will be deemed acceptance thereof.

    • THIRD-PARTY MATERIALS

      iStaging is not responsible or liable for any third party materials included within or linked from the Content or the Services. iStaging provides no representations or warranties, express or implied, with respect to any such materials.

    • TERMINATION AND SUSPENSION OF SERVICES

      If you fail, or iStaging suspects that you have failed, to comply with any of the provisions of this Agreement, iStaging may at any time, without notice to you: (i) terminate this Agreement and/or your iStaging account, and you will remain liable for all amounts due under your iStaging account through the end of the billing period that any such termination occurs; and/or (ii) terminate your license to the software; and/or (iii) prohibit or otherwise restrict your access to the Services.
      iStaging further reserves the right to modify, suspend, or discontinue the Services (or any part or Content thereof) at any time with or without notice to you, and iStaging will not be liable to you or to any third party should it exercise such rights.

    • DISCLAIMER OF WARRANTIES; LIABILITY LIMITATION

      iStaging does not guarantee, represent, or warrant that your use of the services will be uninterrupted or error-free, and you agree that from time to time iStaging may remove the services for indefinite periods of time, cancel the services at any time, or otherwise limit or disable your access to the services without notice to you.
      You expressly agree that your use of, or inability to use, the services is at your sole risk. The services and all content delivered to you through the services are (except as expressly stated by iStaging) provided "as is" and "as available" for your use, without warranties of any kind, either express or implied, including all implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. Because some jurisdictions do not allow the exclusion of implied warranties, the above exclusion of implied warranties may not apply to you.
      In no case shall iStaging, its directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from your use of any of the services or for any other claim related in any way to your use of the services and/or content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the services, even if advised of their possibility. Because some countries, states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such countries, states or jurisdictions, iStaging's liability shall be limited to the extent such limitation is permitted by law.
      iStaging shall use reasonable efforts to protect information submitted by you in connection with the services, but you agree that your submission of such information is at your sole risk, and you hereby release iStaging from any and all liability to you for any loss or liability relating to such information in any way.
      iStaging does not represent or guarantee that the services will be free from loss, corruption, attack, viruses, interference, hacking, or other security intrusion, and you hereby release iStaging from any liability relating thereto. You shall be responsible for backing up your own system, including any content acquired or rented through the services.
      iStaging is not responsible for data charges you may incur in connection with your use of the services.

    • WAIVER AND INDEMNITY

      By using the services, you agree, to the extent permitted by law, to indemnify and hold iStaging, its directors, officers, employees, affiliates, agents, contractors, and licensors harmless with respect to any claims arising out of your breach of this agreement, your use of the services, or any action taken by iStaging as part of its investigation of a suspected violation of this agreement or as a result of its finding or decision that a violation of this agreement has occurred. You agree that you shall not sue or recover any damages from iStaging, its directors, officers, employees, affiliates, agents, contractors, and licensors as a result of its decision to remove or refuse to process any information or content, to warn you, to suspend or terminate your access to the services, or to take any other action during the investigation of a suspected violation or as a result of iStaging's conclusion that a violation of this agreement has occurred. This waiver and indemnity provision applies to all violations described in or contemplated by this agreement.
